Q: How long does divorce mediation take?
A: Sometimes it takes one session, and sometimes it takes a few sessions. This depends upon the complexity of the issues presented by the parties and their ability to communicate and agree.
Q: Do we need lawyers in divorce mediation?
A: I advise my mediation clients to retain counsel to provide them with legal advice. Most often, people wait until they reach an agreement to have an attorney review it, but clients can seek counsel at any time, and I encourage the same. There are some parties who do not retain counsel until after they sign a Marital Settlement Agreement to put through their divorce on an uncontested basis.
Q: What happens if we don’t reach a divorce mediation agreement?
A: Unfortunately, you will have to litigate your differences, and a judge will make decisions in your case that may or may not be beneficial to you. I would note that even in litigated cases, most resolve without trying them. Further, you are required to go to mediation even in contested litigated cases
What Differences Are There between Divorce Mediation And Litigated Divorce in NJ?
The difference between divorce mediation and litigation is that you both make choices that are best for you and your children, instead of your attorney or a judge who does not know you. Of course, any settlement agreement should be reviewed by counsel of your own choosing so that you are properly advised of your legal rights and remedies.
